DITHER YUKI — END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is between you and David Murashka, an independent developer operating under the name "L'eco non di Bergamo" ("we", "us"), and governs your use of the Dither Yuki application ("the Software"), including alpha and beta versions.

1. ACCEPTANCE

By downloading, installing, or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

2. LICENSE GRANT AND USAGE RESTRICTIONS

Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for both personal and commercial use.

The source code of the Software, where made available, is licensed separately under the L'eco non di Bergamo Software License (see LICENSE file). This Agreement governs your use of the compiled application.

You are fully authorized to use the Software to create commercial products. However, you are strictly prohibited from selling, renting, repackaging, or monetizing the Software itself or its underlying source code.

3. ALPHA / PRE-RELEASE SOFTWARE

The Software is provided as an early, pre-release version for testing purposes. It may contain bugs, incomplete features, and may crash, lose data, or behave unpredictably. You should not rely on the Software for critical or production work, and you are strongly encouraged to save your work frequently and keep independent backups of any files you create or edit with the Software. Features, file formats, and this Agreement may change significantly between the alpha/beta version and any future release, without obligation to maintain compatibility.

4. NO WARRANTY

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA LOSS WILL NOT OCCUR.

5. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Mandatory Consumer Protections: Nothing in this Agreement limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by applicable law (including mandatory consumer protection laws in your jurisdiction).

6. YOUR CONTENT AND DATA PRIVACY

You retain all rights, copyright, and ownership to images, projects, media, and files you create or process using the Software (including .dyproj and .dyuki files). You may freely sell and monetize these files.

We respect your privacy. The Software operates locally. We do not access, collect, transmit, or store your files, project data, or personal usage analytics (telemetry) unless you explicitly opt-in to use a specific feature that requires it (e.g., submitting a voluntary crash report or feedback).

7. FEEDBACK

If you provide feedback, bug reports, or suggestions about the Software, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose, including improving the Software, without any obligation to compensate you.

8. TERMINATION

This Agreement is effective until terminated. We may terminate your license if you violate this Agreement. Upon termination, you must stop using the Software. As this includes alpha/beta builds, we may also discontinue access to these pre-release versions at any time, with or without notice, as they are provided for testing purposes only.

9. CHANGES TO THIS AGREEMENT

We may update this Agreement from time to time. Continued use of the Software after changes take effect constitutes acceptance of the updated Agreement.

10. GOVERNING LAW

This Agreement is governed by the laws of the Republic of Lithuania, without regard to its conflict of law principles, unless overriding mandatory consumer protection laws in your country of residence dictate otherwise.

Terms and Conditions

Licensor ("We")

The party offering the Software under these Terms and Conditions.

The Software

The "Software" is each version of the software that we make available under these Terms and Conditions, as indicated by our inclusion of these Terms and Conditions with the Software.

License Grant

Subject to your compliance with this License Grant and the Limitations, Patents, Redistribution and Trademark clauses below, we hereby grant you a non-exclusive, non-transferable, royalty-free right to use the Software for any Permitted Purposes identified below.

Permitted Purposes

You may use the Software for any personal, educational, academic, internal, or commercial purposes. You are explicitly permitted to use the Software to create, process, and produce content for commercial gain.

User-Generated Content and Ownership

All content, projects, media, and files created by you using the Software, including specifically files with the extensions .dyproj and .dyuki, are your sole property. We claim no ownership, copyright, or intellectual property rights over the content you create. You are fully permitted to commercially exploit, sell, distribute, and monetize your original project files and content.

Strict Prohibition on Resale and Code Distribution

While commercial use of the Software's features is permitted, you are strictly prohibited from:

1. Selling, renting, leasing, sublicensing, or distributing the Software itself for financial gain.

2. Selling, monetizing, or commercially distributing the Software's source code or any technical developments, frameworks, or algorithms extracted from the Software.

3. Incorporating the Software or its source code into another commercial software product, service, or offering.

Limitations

You must not move, change, disable, or circumvent any license key or security functionality in the Software; or modify any portion of the Software to:

1. enable access to protected functionality without authorization; or

2. remove the protected functionality.

Patents

To the extent your use for a Permitted Purpose would necessarily infringe our patents, the license grant above includes a license under our patents. If you make a claim against any party that the Software infringes or contributes to the infringement of any patent, then your patent license to the Software ends immediately.

Redistribution

If you redistribute any copies of the Software (which must be strictly free of charge and unmodified), you must include a copy of these Terms and Conditions and not remove any copyright or other proprietary notices provided in or with the Software.

THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, TITLE OR NON-INFRINGEMENT.

IN NO EVENT WILL WE HAVE ANY LIABILITY TO YOU ARISING OUT OF OR RELATED TO THE SOFTWARE, INCLUDING INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF WE HAVE BEEN INFORMED OF THEIR POSSIBILITY IN ADVANCE.

Trademarks

You have no right under these Terms and Conditions to use our trademarks, trade names, service marks or product names, except for identifying us as the origin of the Software.
